| 摘 要： | 在现代复杂社会中,法律解释是一个不容忽视的法学理论和司法实践问题.对传统的制定法主义进行反思,从法理上看司法解释有其存在的必然性,制定法主义及其固有的局限性构成了司法解释得以存在的法律基础.从司法解释的主体角度看司法解释具有有效性.随着社会的多元化,将法官囿于严格的法条主义注定是失败的,如何界定司法解释在法治图景中的位置是横亘在法律人面前的一个古老而又崭新的话题,而这个问题的解决也内涵于如何处理好司法权与立法权及现代和谐社会的关系之中.
