| 摘 要： | 我国刑事诉讼法修改后,取消了免予起诉权,在公诉制度中吸取起诉便宜主义,设立不起诉制度,是顺应刑事诉讼发展潮流,也是符合诉讼经济原则的。但是,在司法实践中发现立法上仍然存在一些不尽完善的地方,本文拟就此问题做一些探讨。
