未成年人刑事案件诉讼程序研究

二次世界大战后,未成年人犯罪急剧上升,与环境污染、吸毒贩毒并称为当今世界"三大公害".呈上升趋势的未成年人犯罪是社会失控的表现之一,成为东西方国家当前共同面临的社会问题,由此推动世界范围内的未成年人犯罪预防与控制立法.根据我国未成年人犯罪的实际情况,结合司法实践的需要,借鉴世界各国的先进经验,构建我国未成年人刑事案件的独立诉讼程序,有利于矫正未成年人犯罪并促进其顺利回归社会,对贯彻党和国家对未成年人犯罪的挽救、教育和改造方针具有深远而重要的意义.

On Litigation Procedure to Juvenile Criminal Case

Since the World War II,juvenile delinquency has increased rapidly,with pollution of the environment and drug to be called "three social evils".The up-trend of juvenile delinquency is one of the performances that the society loses control,having been a widespread problem that the international community faces together and pushing legislation of prevention and control of juvenile delinquency.According to the actual circumstance of juvenile delinquency,integrating the demand of judicatory practice,drawing lessons from the advanced experience of the international community,setting up independent litigation procedure of juvenile criminal case will benefit to correct juvenile delinquency and will benefit them to return society smoothly.It also has a profound and important meaning to carry through the policy of saving,instructing and correcting juvenile delinquency.
