| 摘 要： | 作为案件侦查中的手段之一，侦查讯问程序被世界各国规定在刑事诉讼法中，而通过侦查讯问获得的证据——犯罪嫌疑人的供述和辩解即口供，亦成为诉讼中重要的证据种类。侦查讯问程序对于实现刑事诉讼查明案件真相、发现实体真实的目的具有重要的作用。文章结合国外有关侦查讯问程序的探讨，探究侦查讯问程序在诉讼运作过程中存在程序违法问题的原因，进而对侦查讯问程序进行重构及完善。

| Abstract: | As an investigation mean, investigation and interrogation are regulated in criminal procedure law all over the world, and the evidence is got in investigation and interrogation - - - that is the suspects＇ confession also become important evidence sort in proceeding. Investigation and interrogation play important role in realizing understanding truth in criminal action and finding existence aims. Combining foreign investigation and interrogation procedure, this article discusses the existing causes of illegal procedure to rebuild and perfect the procedure of investigation and interrogation. |
