| 摘 要： | 从案例的角度探讨公安机关人民警察行政不作为违法的具体情况及判断标准,围绕的问题主要是:人民警察在非工作时间是否构成行政不作为违法;工作中采取措施不力是否构成行政不作为违法;人民警察在多长时间内作出行政行为才不构成行政不作为违法;人民警察在治安案件中调解不成又拒绝作出裁决,是否构成行政不作为违法.

| Abstract: | The author attempts to discuss the criteria of administrative nonfeasance by police officers by means of cases. The discussion will be centered around: 1) whether nonfeasance can be committed by a police officer off work; 2) whether the deficiency in work can be regarded as nonfeasance; 3)how long the responding time should be to avoid nonfeasance; 4) whether jurisdiction should be included as a necessary constituent of nonfeasance; 5) whether nonfeasance is tenable when a police officer fails to mediate and arbitrate. |
