中国环境法引进惩罚性赔偿制度宜缓行

针对我国环境法"违法成本低,守法成本高"的症状,一些向"西方求医"的学者不禁会关注到美国环境法上的惩罚性赔偿制度。此制度关注点不再局限于补偿受害人的损失,更具备了惩罚性的特征,增大了违法者的违法成本,亦会对违法者产生威慑作用。但是美国惩罚性赔偿制度的实施具有独特的法律背景及历史沿革,而我国司法实践中,惩罚性赔偿制度尚在探索阶段,且步履维艰,缺乏发挥惩罚性赔偿制度的历史文化背景和司法环境,因此该制度在我国宜缓行。

The System of Punitive Damages in Environmental Law Should be Introduced into China with Carefulness

Based the current symptom of "high price to abide by the law,low price to break the law" in Chinese environmental law,some scholars who seek solutions from the West,can't help but pay close attention to the punitive damages system in American environmental law.This system is not confined to remedying the loss of victims,but also has punitive characteristics,which means it increases the cost of illegality for those who violate the law,deterring offenders.But American punitive damages system has a distinctive legal background and history;in judicial practice in China,punitive damages system is at the initial stage of exploration with difficulties,China Lacks of historical and cultural background and judicial environment to make punitive damages system function,so this system should be carefully introduced into China.
