关于我国民法的若干问题

我国民法大致分为主体、权利、行为、责任四大板块 ,在主体方面 ,就自然人而言 ,主要在婚姻家庭制度方面 ,法人的核心问题是公司法 ,2 0世纪公司法有五个重要的变化值得我们思考 ;权利是民法的核心和灵魂 ,财产权中的物权应该是法定主义 ,人身权应该是非法定主义的 ;行为是人取得权利和行使权利的必要因素 ,无论是交易行为 ,还是投资行为 ,其实质是解决效力的问题 ;责任是法律的最后保障机制 ,民事责任的范围较过去明显增大 ,但其中又涉及到我国是否要规定自力救济手段的问题。

Some Problems Concerned with Civil Law in China

Civil law includes four aspects in China,they are subject,right, action ,responsibility .As for the subject ,taking natural person as an example ,the main aspect which should be concerned about is in the system of marriage and family ,while for legal person ,the kernel will be dealt with by Company Law ,and there are five important changes which should be thought over in Company Law in the 20th century .Rights are the core and spirit of Civil Law ,real right of all rights should be considered as principle of legality ,while personal right should be considered as beyond the principle of legality ;action is the necessary element for a person to gain and exercise his/her right ,either commercing action or investing action ,their substance is to resolve and gain efficiency ;responsibility is the final protecting mechanism of law ,the scope of civil responsibility is much wider than those in the past ,and it concerned with the problem that if any means of self-preservation would be assured in our economy.
