| 摘 要： | 环境容量是描述环境要素纳污能力的自然科学表述。作为一种自然力的功能性载体,由于其具有可感知性、可确定性和相对的可支配性,因此具有成为准物权权利客体的可能。以其为客体而生成的准物权称为排污权,具有使用、收益等基本的用益物权属性,是我国推行环境要素市场化配置、履行《京都议定书》的重要法律基础。

| Abstract: | Environmental capacity is a natural science nomenclature to describe the pollution capacity that accommodated by the environmental stuffs. As a function object derives from nature, it is feasible for them to become the object of the quasi - property because of the characteristics belong to it. The right that established on them can be named as emission right,which includes the purview of usufruct and proceeds. It can be the legal foundation to configure the environmental stuffs by the marketable measures or to fulfill the Kyoto Protocol. |
