我国非法证据排除规则的主要特色

2010年5月30日,"两高三部"联合发布了《关于办理死刑案件审查判断证据若干问题的规定》和《关于办理刑事案件排除非法证据若干问题的规定》,这是我国刑事证据法法制建设上的重要成果。其中,排除非法证据若干问题的规定具有四点鲜明特色:单独立法,世界独创;言简意赅,遣词精当;明定倒置,举证转移;概念周全,分类排除。《两个规定》是在立法机关刑法室不重视刑诉法、证据法修改和完善的情况下,客观形势迫切需要"我的地盘我作主",由中央政法委牵头、"两高三部"制定的具有广泛适用效力的法律文件。《两个规定》的出台,是对立法机关负责人轻视、怠慢态度和行为的警示和抗议。

Main Characteristics of Exclusionary Rule of Illegally Obtained Evidence in China

＂The Two Regulations＂,which are issued by Supreme People＇s Court,Supreme People＇s Procuratorate,Ministry of Public Security,Ministry of Justice and Ministry of State Security on May 30th,2010,are great achievements in the development of our criminal evidence law.There are four main characteristics in excluding illegal evidence,which are singly legislated,simple and clear,converted burden of proof and excluding evidence by categories.Because of the disregard of the amendment of Criminal Procedure Law and Evidence Law by the legislative organs,＂the Two Regulations＂ issued by these five organs and leaded by Central Politics and Law Committee is valid in a very wide area.They are protests to the leader of the legislative organ for his neglect.
