我国破产管理人选任制度的完善路径

我国现有破产管理人制度具有框架性,管理人选任制度的一些问题还需要明确化。破产清算事务所担任管理人时,其在管理人名册编制程序中存在资料提交义务虚置的问题,破产清算事务所与其他社会中介机构的义务不平等,需要尽快建立其行业自律和行政管理体制;人民法院指定个人担任管理人时,在程序上应当与《律师法》相衔接;清算组制度的历史走向应进一步予以明确,首先要有效地防其弊、兴其利,其次可以参考国外立法例,逐步把清算组制度改革为公共管理人制度。
