教唆犯分类论

教唆犯的分类应坚持标准同一、外延周全、多角度进行划分的原则,目的是从不同视角、不同层面深刻认识教唆犯。以教唆犯的教唆方式为标准,将教唆犯分为直接教唆犯与间接教唆犯;以教唆犯的人数和犯罪形式为标准,将教唆犯分为单独教唆犯与共同教唆犯;以教唆犯同被教唆人之间是否实际成立共同犯罪关系为标准,将教唆犯分为分为共犯教唆犯与非共犯教唆犯;以教唆犯的行为特点为标准,将教唆犯分为普通教唆犯、悬赏教唆犯、雇佣教唆犯与网络教唆犯;以教唆犯的教唆内容的明确性程度为标准,将教唆犯分为精确性教唆犯、概然性教唆犯与选择性教唆犯;以教唆犯的主观目的为标准,将教唆犯分为纯粹教唆犯与陷害教唆犯;以教唆犯的停止形态为标准,将教唆犯分为教唆犯的既遂犯、未遂犯、预备犯与中止犯。
