对必然性间接故意之否定

明知必然发生能否放任是刑法学上的重要问题,直接影响对案件的量刑,因而有必要对其进行系统的介绍和分析。采用生活意义上的必然性概念以及从整个犯罪过程动态的角度对放任进行分析,结论是不可能存在明知必然性而放任的心理状态;对于明知必然发生只能采取希望的意志因素,在这种情形下应当是直接故意。
