论原因自由行为——以行为和因果关系为视角

近年来,以醉酒、吸毒后自陷责任能力缺失或者耗弱之状态而实施危害社会行为的现象已引起了普遍的关注,且目前我国法律不足以解决这种问题。学者们主张引入大陆法系刑法的原因自由行为理论,但通过对现有国外学说进行评价和分析,发现无论哪一种学说都未能很好地解决原因自由行为承担刑事责任与责任主义原则之关系,故此提出以概念和分类为前提,以行为理论和因果关系理论为基础的原因自由行为理论。
