| 摘 要： | 疑难案件的本质是规范与事实对应过程中的主体价值判断冲突,其处理过程要运用不同类型的论证组合进行复合论证,其处理结论还要同时接受内部证立和外部证立的检验。检察委员会疑案决策应符合疑难案件复合论证机理,并注重利益衡量方法的运用,利益基点应定位于有效化解社会矛盾、维护社会和谐稳定。

| Abstract: | The essence of disputed cases is subject value judgment conflict when the norms correspond to the facts.The solution should be applied with different type of combined argumentation and tested by internal and external justification.The procuratorial committee should solute the disputed cases through complex argumentation and emphasis interest measurement.The basic point of interest measurement should position itself on settling confliction and establishing a harmonious and stable society. |
