| 摘 要： | 在控辩审刑事诉讼格局下,肯定值班律师辩护人诉讼身份的应然定位是实现认罪认罚案件中犯罪嫌疑人、被告人获得有效辩护的保障,也是认罪认罚适用简易程序的正当性基础。文章在论述这一正当性的基础上,从界定值班律师诉讼身份、明确介入时间、强化诉讼权利及保障相关配套措施等方面提出了完善值班律师制度的具体构想。

| Abstract: | In the pattern of criminal litigation,affirming the duty lawyer’s litigant identity is the guarantee for the criminal suspect and defendant to get effective defense in the case of guilty plea and punishment,as well as the legitimate foundation for the application of summary procedure of guilty plea and punishment.On the basis of this justification,this paper puts forward some concrete ideas of perfecting the system of duty lawyer from the following aspects:defining the duty lawyer’s litigation identity,defining the intervention time,strengthening the litigation right and protecting relevant supporting measures. |
