我国公众司法参与问题探讨——基于制度化参与的分析进路

当前,司法民主化改革的取向、社会主体复杂的利益冲突、互联网技术的广泛使用,为公众司法参与提供了制度空间、基本动因和技术平台。作为一种制度安排,我们应对公众司法参与进行系统性的逻辑建构,包括司法基本信息的知情机制、司法运作过程的监督机制及司法运作结果选择的回应机制等,这将在制度化的基础上不断实现司法机关与公众的良性互动。

Exploration of Judicial Participation of the Public in China——Based on Analysis of Institutionalized Participation

At present,the orientation of judicial reform in democratization,complicated conflicts in interests among social main parts and extensive use of internet technology have provided system room,basic agent and a technological platform for judcial participation of the public.As an arrangement of systems,we need to promote the development of the participation in a logical way,including establishment of mechanisms for knowing basic information on judicature,overseeing the process of judicial operation,and respouding to the chosed result of judical operation.This will promote benign interaction between judicial organs and the public.
