侦查程序价值论

侦查程序有其独特价值,这种价值是法律价值在侦查这一法律程序上的特定化,但是不能将法律价值或诉讼程序价值直接套用为侦查程序价值,侦查程序价值有其独特范畴和个性内涵。侦查程序价值包括外在价值和内在价值两个范畴。侦查程序的外在价值主要体现在公诉和审判基础、权利保障、犯罪控制、效益实现等方面;侦查程序的内在价值主要诉求于侦辩双方平等对抗、侦查程序恪守法律运行、侦查程序多方主体参与、侦查程序相对独立、侦查程序适度公开、科学技术广泛应用等方面。

On the Value of Investigative Procedure

Investigative procedure has its unique value which is part of legal value specified in the procedure of investigation. Nevertheless, we should not confine legal value or the value of practice as the value of investigative procedure since the latter has its distinct domain and individual connotation. The value of investigative procedure can be divided into the following two categories: external value and interenal value. The external value consists in the foundation of public prosecution and adjudication, the safeguard of rights, the control of crime, etc.. Meanwhile, the internal value lies in the equal confrontation between investigation and defense, the participation of various parties in the investigative procedure, the relative independence of investigative procedure, etc..
