非法口供的认证标准

此次刑事诉讼法再修改，非法证据排除规则的改革成为重中之重，作为其子规则之一的非法口供排除规则更获得万众瞩目之殊荣，遗憾的是修改后的非法口供排除规则始终未能为司法实践中对非法口供的认证活动提供规范和引导，致使实践中法官判断非法口供的活动缺乏最重要的技术性支持而难以确保其统一性和确定性。因此，必须为非法口供的认证活动设置相应的认证标准．指导法官正确认定非法获取口供行为的范围，进而综合衡量非法行为对被追诉人权利侵害的程度，在此基础上做出是否排除非法口供的决定。

The Judgmental Criterion of Illegal Confession

As the most important part of the exclusionary rules, the confession rule attracted a lot of attention during the amendment of the Criminal Procedure Law. However, the amendment failed to define the ＂illegal confession＂ and to provide the judgmental criterion of illegal confession, which resulted in chaos during the judicial practice of these rules. Therefore, it is the right time to establish some judgmental criterions as guidance for judges to determine the illegal confessions.
