| 摘 要： | 单位已经被吊销营业执照,对实施犯罪行为的该单位直接负责的主管人员和其他直接责任人员追究刑事责任,对该单位不再追诉。当然,司法机关不再追诉被吊销的单位,并不代表犯罪单位一旦被吊销营业执照后就逃避制裁。被非法吸收的存款作为特定公众的合法财产理应得到法律的保护,通过民事领域的相关法律予以救济则顺理成章、名正言顺。
