| 摘 要： | 就我国宪法诉讼而言,存在着宪法诉讼的观念意识淡薄,宪法诉讼含义界定不明,术语表达不一,宪法诉讼的可行性态度截然相反,宪法诉讼的法律依据认识有异,宪法诉讼机构模式选择分歧甚巨,宪法诉讼第一案的说法看法不同,与宪法诉讼紧密相关的若干概念混杂难辨,宪法诉讼的实务操作缺乏相应具体的法律支撑等诸多困惑,对此需要进一步探究。

| Abstract: | Many puzzles exist in the constitutional action in China, such as indifference to it in the subjective consciousness, undefined definition of its concept and inconsistency with each other, completely contradictory attitudes to its feasibility, different opinions on its legal basis, divergence among the selections of its institutional models, different comments on its first application, obscurity of some relevant concepts, lack of relevant legal adjustment mechanism in its practice. It needs further study. |
