确定建筑物所有权的依据

摘    要:建筑物所有权须以土地权利为其正当根据。土地权利可以是建设用地使用权、宅基地使用权,也可以是集体土地所有权、集体土地使用权,还可以是国有土地租赁权。物权法第142条的但书内容应当指国有土地租赁权为建筑物所有权的正当根据。市政公共设施所有权、职工购买的公有住房都应当以建设用地使用权为其正当根据。

Abstract:The ownership of structures should take landed property right as its legitimate basis.Landed property right can be the land use right for construction,right of the use of house site,collective ownership and right of use of land and even leasing right of the state-owned land.According to the item 142 in the Law of Real Right,leasing right of the state-owned land is the legitimate basis of the ownership of structures.Therefore,the ownership of the municipal public installation,public housing that staff purchased should also take landed property right as legitimate basis.
