| 摘 要： | 传统的犯罪构成只包含积极的构成要件,这与我国刑事立法的规定和刑事司法的实践不相吻合,立足刑事立法,面向司法实践,应该将刑法第13条但书和正当防卫等排除犯罪性的行为作为犯罪构成的消极要件纳入我国的犯罪构成之中。

| Abstract: | Traditional crime constitution only consists of positive elements,which is out of accord with the legal provision and practice.Based on the legislation,we should bring reasonable acts and the proviso of article 13 within the orbit of crime constitution as negative elements,so as to satisfy the requirement of judicial practice. |
