| 摘 要： | 会首的法律地位首先表现为它是一份合同或一组相关联的合同的当事人,其次,会首也承担合法发起合会、接受合会合同行政管理、执行合会事务、收取、保管、交付会款、代垫会款等义务并对倒会负直接责任或连带清偿责任,以及因不履行其特定义务而承担相应的民事、行政和刑事责任。

| Abstract: | The legal status of the foreman in a "Hehui"(a kind of non-governmental money-raising group),above all,reveals as a party concerned of a contract or a series of relevant contracts.Secondly,a foreman in a "Hehui" must take charge of the following responsibilities: to initiate legally;to accept the administrative management according to the contracts;to arrange the affairs concerned;to collect,safe-keep,fill up the total fund,then to handle it up to the winner.Also,he should be responsible for the insolvency.What's more,he should bear corresponding civil,administrative or criminal responsibility. |
