论法律规范的内在不平衡结构

占统治地位的法律规范结构理论因为背离了结构分析所要求的存在论论域而难以站得住脚。通过对构成规范的要素及其逻辑关系的“共时性”考察可以看出,法律规范乃是由作为规范性存在的两种规则形态即调整性规则与管理性规则构成的偏正结构：前者表达了规范的目的,而后者则是规范目的实现的手段。目的与手段的分离所造成的必然后果是工具理性的法律现实主义,由此法律的规范性下降不可避免,此即法律自身的悖论所在。

On the Imbalance Structure inside Legal Norms

The ruling theory of structure of legal norms can hardly hold water since it deviates from the field of ontology which is required by structural analysis.After analysing the elements which constitutes legal norms and the synchronicity of their logical relations,the author draws a conclusion that legal norms are a structure of modification.The structure consists of both adjusting rules and administrative rules,of which the former shows the goal of the norms while the latter is a means to this end.The separation between the means and the end brings about the legal realism of instrumental rationality which inevitably reduces the standardization of legal norms.
