| 摘 要： | 中国物权立法所存在的巨大争议很大程度上源于物权立法的价值不清。物权立法的价值在于继受物权法律文明、承接现行宪政体制、反映时代国情特点,为当今中国制定一部真正意义的财产基本法。据此,物权立法新一轮争论正反双方的观点和方式都有失偏颇。但这场争论却能促使人们去认真反思物权立法的失误,以及如何使物权立法趋于完善。

| Abstract: | The big controversy among the right in rem legislation of China comes from the implicit value of the legislation of the right in rem.The very value of the legislation of the right in rem does exist in inheriting the civilization of the right in rem law,connecting the system of constitution and reflecting the fundamental realities of the country of times,thus enacts a fundamental property law of real significance for the current China.That is to say both sides of the new round controversy of the legislation of the right in rem are not right.But this round of controversy can lead people to meditate the errors in the legislation of the right in rem and how to better the legislation of the right in rem. |
