| 摘 要： | 惩罚性赔偿在合同领域的适用有其正当性,已经为各国立法和司法所肯定,我国现行法律、法规亦有相应规定。惩罚性赔偿作为一种私法性质的法律责任,应当在民法典中予以规定。建议在民法典合同编违约责任中增加惩罚性赔偿的有关规定。

| Abstract: | Application of the way of punitive damages has been justified in the field of contract.It has been assured by many countries in legislation and jurisdiction.It also can be found in current regulations and laws in China.So it should be specified in China Civil Law as a kind of legal responsibilities of private law.A suggestion that the way of punitive damages,as a sort of liability for breach of law,be written in contract part of China Civil Law. |
