| 摘 要： | 盗窃网络游戏虚拟财产的行为，以盗窃罪定论是一种趋势。但这一定性在法理上难以解决某些疑问。在现有刑法语境下，在认同科技发展的大背景下，设立新型盗窃罪，具有合理性与现实性。
