| 摘 要： | 随着经济的不断发展,市场经济越来越活跃,在市场经济逐利性的驱使之下,不正当的利用各种手段获取利益并损害其他经济主体利益的情况层出不穷,而我国于1993年制定的《反不正当竞争法》已经无法适应飞速发展的经济生活,新型的不正当竞争行为损害着市场上的其他主体及公平的竞争环境.为此,必须对现行法律进行修正,确立真正的一般条款,使其具备一般条款的基本特征,以扩大《反不正当竞争法》的适用范围.

| Abstract: | Along with the development and activeness of the market,under the market economy driven by profit,acts that use of various improper means to get interests and undermine the interest of the other economic agents occur.While the anti unfair competition law of China enacted in 1993 has been unable to adapt to the rapid development of economic life.New type unfair competition conducts harm the benefit of other entity and just circumstance of the market.Therefore,we must amend the enacting law,establish general article,as a result,to enlarge the application of the anti-unfair competition law. |
