涉外劳动合同的法律适用问题研究

摘    要:劳动法的域外效力问题是研究涉外劳动合同法律适用的前提。对涉外劳动合同的法律适用存在着许多争论。本文在分析各国的立法和司法实践的基础上,结合中国的实践提出我国立法应采取的法律适用规则。

On the Applicable Law of Employment Contract with Foreign Elements

Abstract:The extraterritorial effect of labour law is an important issue in studying the applicable law of employment contract with foreign elements. This thesis introduces the legislations and judicial practices of several countries, makes an analysis of the following conflict rules: the principle of party autonomy and its confinement, the most close relationship principle and so on. It adopts both methods of positivism and comparative research approach.
