论被害人承诺的推定

被害人承诺作为刑法上的一种阻却违法性事由,由于情形相当复杂,在界定上存在许多问题。在现实中,有时被害人的承诺并不实际存在,但是根据各种情况可以推断出被害人在这种情况下必定会作出承诺,这就是被害人承诺的推定。基于推定本身是一种结合主观和客观的证明方法,以及推定情形的复杂性,推定必须在理清各种情况的基础上灵活地加以判断。
