| 摘 要： | 犯罪构成符合性判断包括涵摄和等置两种不尽相同的思维模式。在犯罪构成要件含义明确的案件中,凭借经验就可以判断出事实要件是否符合对应的构成要件,这是涵摄的思维模式;但在构成要件含义不明确的案件中,必须通过比较事实要件与构成要件的典型事实是否具有法律意义的同一性来判断事实要件是否符合对应的构成要件,这是等置的思维模式。

| Abstract: | Judgment of conformity between constitution of crime and criminal case is made up of subsumption model and equalization model.When the meaning of legal element is clear,we can recognize the conformity by experience.This is so-called subsumption model.However,when the meaning of legal element is not clear,we must recognize the conformity by comparing the factual element and typical fact.This is so-called equalization model. |
