我国适应专利权穷竭原则及构想

专利权穷竭原则已在世界范围内被广泛认可,根据其空间适用效力可分为国内、区域和国际三种。专利权穷竭通过对权利人的必要限制以实现个人与社会之间的利益平衡,理论基础可分为默认许可和专利权用尽理论。我国应当通过灵活运用区域内合作的方式以促进更广范围的专利权穷竭,在实践中适用有限制的国际穷竭原则——以国内穷竭适用为一般,国际穷竭适用为特例。
