论高速公路收费的法律适用

目前,我国高速公路收费实行的是行政审批制度。行政审批制度是计划经济的产物,适用该种制度,从价值上讲容易导致权力寻租,滋生腐败;从效力上讲不能对外产生法律效力;从程序上讲有悖于正当程序原则,最终将导致公路收费存在诸多问题。随着相关法律制度的完善,高速公路收费已经不宜适用行政审批制度,有必要重新确立适用高速公路收费标准的法律制度。
