民事再审程序司法解释之评析

《最高人民法院关于适用（中华人民共和国民事诉讼法）审判监督程序若干问题的解释》从总体上看，是遵循民事诉讼的规律，依据民事诉讼的特点，总结审判实务中的经验，吸取理论研究的成果而制定的，具有务款多、规定细、内容新的特点。但是，对于如何界定“明显违背立法本意”和“严重违法行使管辖权”，该司法解释中的若干规定仍有探讨和商榷的余地，也还存在进一步改进、完善的空间。

Comment on the Judicial Interpretation of Retrial Proceeding of Civil Procedure Law

Last year the Supreme Court issued explanation for civil retrial proceeding of civil procedure law. Generally speaking, ＂Judicial interpretation＂ follows the rules of Civil procedure, which depends on the basis characteristics of civil procedure, summarizes the experiences of trail and absorbs fundamental research achievement, has the characteristics of many provisions, detailed stipulations and new contents. But, how to limit ＂violates the legislative original intention obviously＂ and ＂serious jurisdiction violation＂, in new judicial interpretation＇s certain stipulations, still need urgent perfection.
