| 摘 要： | 超法规违法阻却事由在大陆法律中存在的必要性,在我国耦合性的犯罪构成下,社会危害性同样起到了实现实质公正和抑制刑罚权的功效,因此,在我国超法规违法阻却事由不具有其存在空间。
