摘    要:劳动教养制度作为一种行政处罚措施,不仅过于严厉,适用对象过于宽泛且具有不确定性,同时还存在适用程序上的不合理性、与我国政府签订的有关人权保护的国际公约的直接冲突等问题,造成对人权的直接侵害。

Abstract:As a kind of punishment of administration measures, the system of the physical labor correction is not only over severe but also those to whom the punishment are applied are not definite. Moreover, the procedure is quiet unreasonable, there are conflicts between the international conventions about the safeguard of human rights. All of which encroach the human rights.
