关于腐败内涵的界定

目前国内外的腐败内涵尚未统一。以中国历史、域外腐败内涵为基础,总结辨析出腐败的基本构成要素:涉权性,交换性,交换的不正当性,结果超越了公共领域和私人领域之间的区分,侵犯了公共利益,最后从这四个要素出发,在广义和狭义上来界定腐败的内涵,以满足社会学和法律界的两个视角和标准。

To Present the Connation of Corruption

There isn't unified connotation of corruption at home or abroad up to now.Based on the connotation in history of China and enumeration of abroad,this paper sum up the essential element,i.e.relevance of power,quality of exchange,the exchange is considered as anti-upright,result is that break the dividing line between public and personal area and infringement on public interest.At last,concerting these four elements,it presents the connation of corruption in broad and narrow sense,in order to satisfy two kinds of angle and standard-social science and law field.
