冲突法理论的价值追求

不同历史时期的冲突法学说具有不同的价值追求。传统冲突法学说以国家为本位分配国家的立法管辖权,强调冲突规范的确定性和追求冲突法公平;现代冲突法学说更加关注个人的利益,强调冲突规范的灵活性和追求实体法公平。后现代冲突法学说的价值追求应该是国家、个人和社会利益的和谐统一,冲突规范的确定性与灵活性的合理平衡和冲突法公平与实体法公平适当兼顾。

on the Values-orientation of Conflict-of-laws Theories

The values-orientation of conflict of laws theories at different periods are very different.On the basis of historical comments and value-analysis on the features of various conflict-of-laws theories,this article concludes that the values-orientation of traditional theories are to allocate legislative jurisdiction,to emphasis the certainty of conflict rules,and to pursuit conflicts justice on the basis of nation-centricity;while modern theories pay more attentions to the justice to parties,the flexibility of conflict rule,and focus on the material justice.After considering the changing world in 21st century,the authors argue that the values-orientation of post-modern conflict-of-laws theories should pursuit the harmonious unification of interests among nation,individual and society,the reasonable harmonization between certainty and flexibility of conflict rules,and the proper consideration between conflicts justice and material justice.
