| 摘 要： | 公平合理的法定刑是司法公正的前提和基础 ,而我国《刑法》中的某些规定有悖罪责刑相适应原则 ,表现为法定刑轻重倒置、法定刑轻重失衡、法定刑轻重不分。建议尽快修改相关规定 ,以使《刑法》分则所规定的法定刑达到罚当其罪的要求。
