| 摘 要： | 文章主要比较了中国的行政全同制度与美国政府合同制度，在概念、基础原则、程序和救济四个方面进行了一些研究。在概念上有一些差异，基本原则有很多的相似之处，可以相互借鉴，在订立程序和救济方式上我国应学习美国的先进经验。

| Abstract: | This article mainly compares the administrative contract between China and America, concentrating on the conception, the basic principles, the procedure and the litigation. The article hold that there are many differences between the concepts, while the basic rules are similar. We must learn the advanced experience from America on the procedure and the litigation. |
