| 摘 要： | 信用卡犯罪日益猖獗,危害甚大。我国刑事立法有疏漏之处,难以遏制。《中华人民共和国刑法修正案(五)》主要从源头上对信用卡犯罪作了较全面的立法完善,以维护正常金融秩序,保护金融机构和公众合法利益,便于司法操作和国际合作。要做到准确适用,就有必要从立法精神上予以理解、把握。

| Abstract: | The crime of the credit card is rampant day by day, it has very great danger. The criminal legislation of our country is dredged but leaks, and difficult to contain it. "the fifth amendment in criminal law" has done more overall legislation to the crime of the credit card perfectly from the source mainly, in order to maintain the normal financial order , protect the financial institution and public legitimate interests, be convenient to administration of justice operates and international cooperation. it is necessary to understand, hold it from legislative spirit. |
