高校处分制度的法制构想

目前由于长期以来普遍存在的管理行为不规范、法律体系不健全等等问题,我国公立高校侵犯学生合法权益的现象时有发生,学生与学校之间的法律纠纷也逐渐增多,主要集中在被传统视为权力保留领域的高校处分权问题上。在当前构建和谐社会的大背景下,应当正确对待高校处分制度的设定和执行问题,限制高校的自由裁量权,以充分保障高校学生的受教育权,保护学生的合法权益和自由。

Legislative Thinking of the University Dispose System

At present because the ubiquitous administration behavior is substandard for a long time,and the legal system is imperfect in the public university of our country,the students' legitimate rights are sometimes encroached on,the legal disputes between the students and the universities also gradually increase,and that concentrates on the power of punishment of universities regarded as keeping power field by the tradition.Now under the background of building a harmonious society,it should be a correct view of the university punishment system settings and implementation issues,limit the free jurisdiction rights of the university,in order to fully protect the right to the students' education,protect students' legitimate rights and interests and freedom.
