| 摘 要： | 公民社会保障权利的实现依赖社保制度的法制化与社保权利的可诉化,而司法权力不具备相关合法性以及社保制度应当突出政策性的观点成为限制塑造与完善社会法请求权的障碍。德国社会上的形成请求权制度为我们消除这些障碍,寻求构建社会法请求权体系的突破提供了有益的启示。

| Abstract: | Realization of citizens’ social security right relies on legalization of social security system and justiciability of social security right. However, the view of unlawfulness of judicial power and that social security system should highlight policy become the obstacles of the shaping and perfection of social law claim right. Claim right formation system in German society provides many helpful enlightenments for us to eliminate these obstacles and to seek for breakthroughs in the construction of social law claim right system. |
