技术侦查的确立对刑事诉讼目的的影响——从功利主义的观点出发

2013年1月1日正式实施的刑事诉讼法确立的技术侦查措施,是立法者诉讼理念的转变,将技术侦查措施的授权从普通法律提升到国家基本程序法的高度,有利于技术侦查规范化和法治化,对于刑事诉讼能够充分发挥打击犯罪与保障人权作用,具有重大进步意义。但囿于现阶段立法的不健全不完善,技术侦查措施在司法实践中亦将难施拳脚。文章将在对技术侦查措施对实现刑事诉讼目的利弊进行分析的基础上,运用功利主义的合理观点,从取证手段横向比较与"保护"和"侵犯"纵向权衡两方面,分析当前技术侦查措施对刑事诉讼目的的影响,并提出相应完善建议。

The Influence of the Establishment of Technical Investigation on the Objective of Criminal Procedure-From the Viewpoint of Utilitarianism

The technical investigation measures were formally implemented in the law of criminal procedure on January 1st, 2013. This shows the change of lawsuit idea in legislation. The implementation of upgrading the technical investigation measures from ordinary law to the height of the national basic procedural law will help to normalize and legitimize technical investigation, and play an important role in fighting crime and protecting human rights. But the present unsound and imperfect legislation makes technical investigation measures hard to be fully used in the judicial practice. Based on analyzing the advantages and disadvantages of the technical investigation measures to achieve the objective of criminal procedure, this article analyzes the influence of the technical investigation measures on the criminal procedure, and proposes corresponding suggestions to make it perfect by applying utilitarianism from reasonable point of view, and horizontal comparing it with forensics means, vertically comparing it with“protection”and“infringement”.
