论侦查学的逻辑起点及其理论演绎

我国侦查学一直没有确立体系构建的逻辑起点,致使学科无法完成理论演绎,形成经验主义特征,缺乏理论价值。侦查学的逻辑起点是对犯罪事实的辩证性质断定所形成的自然属性和社会人文属性二重性命题。侦查学经由逻辑起点展开理论演绎必须解决以下几个问题:确立自然属性研究的基础地位;准确把握社会人文属性研究的维度;构建自然和社会人文属性相融合的理论样态;形成学科理论概念、范畴。

Logic Start Point of Investigative Discipline and Theory Reasoning

There has not been a logic start point of investigative discipline system in the past,which results in some problems which have not finished theory reasoning,the lack of subject values as to take shape an empiricism practice.The logic start point of investigative discipline is a duality proposition with the nature of natural and social humane studies,which derive from the way of dialectical logic in which it considers criminal facts.If we use the logic start point to make a reasoning in investigative discipline,some problems would been resolved,such as to set a fundamental place of its natural status,to recognize an approach of its social humane studies and reconstruct a theory model with the multi-nature of social humane studies in order to reach workable theory concept of investigation discipline.
