论人体器官移植的立法原则

本文通过对世界主要国家尸体器官移植立法原则的评述,阐明了这些立法原则存在的利弊。结合我国缺乏供体来源的国情,借鉴外国立法经验,根据权利协调原则指出我国应采取自愿捐献与需要决定相结合的立法原则。并论述了公民生存时自愿捐献组织器官应属公民对身体权的支配,该行为应当受到法律的严格限制,遵守一定的立法原则。

Legislation Principles of Human Organs Transplant

This article sets forth existing advantages and disaavantages of humanorgans transplant after death in different countries and their legislation principles. And it points out that in China we should stick to the legislation principle on the base of joining together free-will contribution and demands. Also it discusses the right to contribute organs when alive and the limitation of this right from the point of law.
