排除合理怀疑是英美法系刑事证明标准的经典性表述 ,但其到底是如何产生的 ,一直是一个有争议的问题。对于应否对其进行定义 ,在理论和司法实践中也一直争论非常激烈。对其涵义的界定主要有七种方式。当前 ,排除合理怀疑在西方面临着严峻的挑战 ,原因主要来自三个方面 :一是自身涵义过于抽象和模糊 ;二是司法实践中对其界定相互矛盾 ;三是缺乏可操作性。

Beyond Reasonable Doubts and the Challenge In Western States

Beyond reasonable doubt is the classic formula in Anglo-American law system. There is much controversy over when it originated. Whether it should be defined is very controversial too in theory and judicial practice. There are seven major patterns to define it. Now beyond reasonable doubt is faced to critical challenges. The reason comes from three aspects: First, its implication is too abstract and indistinct; Second, the definition that is entrusted in practice is paradoxical mutually; Third, it is unworkable.
