论我国反对针对妇女的家庭暴力的立法完善--以妇女人权公约为尺度的考察

针对妇女的家庭暴力是对妇女基本人权的侵犯,随着家庭暴力问题的日益突出,联合国及其成员国越来越关注在反对针对妇女的家庭暴力的国际法和国内法的发展与完善.以妇女人权公约为尺度进行考察,我国应当通过制定专项反家庭暴力法、明确警察机构的职能、对婚内强奸进行明文规定、设立民事保护令制度以及在法院开设家庭暴力专庭等方面进一步完善我国反对针对妇女的家庭暴力的立法,更好地保护妇女的基本人权.

Legislative Perfection of Our Country's Countermeasure against Domestic Violence Aiming at Women--observation through convention of women's human rights

Domestic violence aiming at women is the invasion to women's basic human rights,alone with the protruding of domestic violence problem,the United Nations and its members pay more and more attention to the development and perfection of international law and domestic law against domestic violence aiming at women.From observation of convention of women's human rights, our country should perfect the legislation of domestic violence aiming at women from formulating special anti-domestic violence law,identifying the function of police agency,stipulating the rape of spouse clearly,setting up civil protective order system and holding a court of anti-domestic violence,in order to protect basic human rights further.
