文化法2.0时代博物馆知识产权风险控制研究

数字博物馆的建构促使博物馆的文物藏品展览由管理者为中心转变为访问者为中心,在增加文化内容创造、保存、传播和利用方式多元性的同时加剧了文化发展进程中的复杂性和溢出效应。传统博物馆在关注建构数字博物馆的技术议题时也应同步关注数字博物馆的潜在知识产权要素,完善知识产权风险识别工作,包括数字化前的资产清查工作和数字化成果的知识产权风险梳理。对于潜在的知识产权风险,博物馆可采取消极的侵权应对策略及主动的著作权许可策略,同时需注意的是,博物馆应当注意公益性与知识产权私权保护之间的冲突,突破保守的知识产权守护者角色,对部分进入公有领域的文物藏品开放获取,增强其开放性、包容性。

On Intellectual Property Risk Control of Digital Museumin Age of Cultural Law 2.0

The construction of the Digital Museum in the Age of Cultural Law 2.0 has promoted the display of museum’s collection of cultural relics from curator centered to visitor centered,and intensified the complexity and spillover effect in the process of cultural development while increasing the diversity of the creation,preservation,dissemination and utilization of cultural content.When paying attention to the technical issues of constructing digital museums,traditional museums should also pay attention to the potential intellectual property factors of digital museums and improve the identification of intellectual property risks,including asset inventory before digitization and intellectual property risk review of digital results.For potential intellectual property risks,museums can adopt negative infringement coping strategies and proactive copyright licensing strategies.At the same time,it should be noted that museums should pay attention to the conflict between public welfare and intellectual property rights protection,break through the way of conservative intellectual property protection,and then make the public access to some cultural relics in the public domain to enhance their openness and inclusiveness.
