国际私法的逻辑体系与立法定位

Logical Systemand Legal Orientation of Private International Law

Logical framework of private international law was produced and improved based on more research on issues concerning legislation of jurisdiction with the development of foreign-related civil relations and requirements of solving international law conflicts.It has been a long time that research on theories,legislations and judicial practice of private international law put focus on choice of law,in order to realize rationality of logical reasoning when choosing law and obtain conflict fairness and substantive fairness in localization analysis of international cases.However,in deeper respect,the function of balance and value of methodology which private international law exercises can be realized only by starting with ascertainment of jurisdiction based on localization analysis,combining related conflict rules and procedure rules,integrating particular jurisdiction and their legal rules to guarantee certainty and rechtskraft of decisions.Therefore,the best solution to construct reasonable legal system in current society is to produce integrate comprehensive private international law involving jurisdiction,choice of law,service,and recognition and enforcement of verdicts.
